The Appeal Court in Belfast will hear a challenge to the protocol by a group of unionist politicians, including former DUP leader Arlene Foster and Baroness Hoey. They want to overturn a ruling by Belfast's High Court in June that Northern Ireland's post-Brexit arrangements are lawful.
The two-day hearing comes amid tensions between Britain and Brussels over the protocol.
The protocol effectively places Northern Ireland in the EU's single market for goods to avoid a hard border with Ireland.
But this has led to checks on goods crossing from Great Britain to Northern Ireland, creating a barrier to trade within the UK.
Relations between Britain and the bloc are also strained over a post-Brexit fishing row with France.
