Sir Keir Starmer is facing calls to send ten thousand foreign prisoners languishing in crammed UK jails back to their home countries.
The Government has announced plans to release thousands of inmates back on to the streets, claiming the measure is essential in order to prevent jails running out of room.

But figures from the Ministry of Justice show there are 10,422 foreign nationals held in custody - around one in eight of all prisoners. Of these, 6,632 have been convicted of a crime and sentenced while others are on remand.
The Home Secretary has a legal duty under the UK Borders Act 2007 to deport any person who is not an Irish or British citizen who is sentenced to at least 12 months in prison, unless it would breach their human rights. They also have the power to deport any non-British person when it would be “conducive to the public good”.

Reform Deputy Leader Richard Tice said: “It is clearly ‘in the public good’ to deport all 10,000 nationals in our jails, both convicted and on remand.”
The MP said: “This is the right thing to do in itself, and will free up space in our prison system that will mean that there will be no need for thousands of prisoners who have not completed their sentence to be released early.”
The most common non-British nationality in UK jails is Albanian, with 1,273 inmates, followed by Polish, with 906, and Romanian, with 750.
Justice Secretary Shabana Mahmood last week insisted the policy of releasing prisoners was essential to stop jails running out of space within weeks, leading to “a total breakdown of law and order”.

She said prisons were “on the point of collapse” with barely 700 places left in the adult male estate and jails operating at 99 percent capacity since the start of 2023.

The plans set out by Ms Mahmood would see a temporary reduction in the proportion of their sentence many prisoners must serve in jail from 50% to 40%.
It is expected to come into force in September, giving the Probation Service time to plan for offenders’ release.
