JOHOR BARU: About three years ago, a lorry driver was caught for having in his possession pornographic videos in his mobile phone.
Then on Malaysia Day last week, the 42-year-old allegedly committed an act of gross indecency in his apartment unit that was seen by a neighbour.
Following this, the accused was charged at a magistrate's court on Monday (Sept 20) for indecent and obscene behaviour, as well as having pornographic videos on his mobile phone.
Muhammad Mahadzir Abdullah, however, only pleaded guilty to the one of the charges before magistrate Mohd Zulhilmi Ibrahim.
According to the charge sheet, the accused was found in possession of pornographic videos in his mobile phone at about 6pm on Aug 18, 2018.
For the second charge, he allegedly committed an act of gross indecency that was seen by a neighbour at about 7.15pm on Sept 16 this year.
Both offences were allegedly committed at an apartment in Pangsapuri Aliff Residences, Tampoi, here.
The first charge is an offence under Section 292 of the Penal Code for possession of obscene objects, which provides for a maximum jail term of two years, upon conviction.
The second charge, under Section 377D of the same Act, carries a jail term of up to three years or a fine or both.
The accused pleaded guilty to the first charge and was fined RM1,500, in default three months' jail.
Muhammad Mahadzir, however, claimed trial to the second charge and was granted bail of RM2,500 with one surety.
The case was prosecuted by Benedict Choong Kai Qi while the accused was not represented.
The court set Nov 9 for next mention.
