KOTA KINABALU: A man who sent pornographic photos to a woman via Facebook messenger will spend six months in jail after he failed to pay the RM10,000 fine imposed for the offence.
Abdul Wahab Ismail, 30, who is currently serving jail time for another unrelated offence, pleaded guilty to two counts of the charges before Sessions Court Judge Noor Hafizah Mohd Salim on Tuesday (March 29).
He was ordered to pay RM5,000 for each charge, or three months imprisonment respectively if he failed to pay.
In the charge sheet, he was accused of sending the pictures to the woman, where her face was seen, on Sept 4, 2019, and on Oct 9, 2019 at a village in Bongawan, Papar.
The woman had previously lodged a report on the matter, as she was worried that Abdul Wahab would spread the pictures to other people.
It was not revealed in court whether the pornographic pictures were hers or edited, or if she and Abdul Wahab were related in any way.
During mitigation, he asked for leniency saying that he has been in jail for over a year for another offence.
Abdul Wahab, who was unrepresented, could not afford to pay the fine.
Prosecuting officer Nazrul Nizam from the Malaysian Communication and Multimedia Commission urged for an appropriate sentence to be imposed so that it would serve the offender a lesson and the public a warning.
