YouTuber charged with uploading insulting MCO video on his Facebook page

       IPOH: A YouTuber was charged at a Sessions Court here for uploading an insulting video in relation to the movement control order on his Facebook Page.

       Roshafee Abdul Hamid, 39, pleaded not guilty when the charge was read before Sessions judge Norita Mohd Ardani on Friday (Dec 17).

       Better known as "Apit Wan Lebo," he was known to upload videos using that profile name on current issues plaguing the country.

       According to the charge sheet, Roshafee had uploaded the offensive video with the intent to offend others on May 9 this year at about 1.30pm.

       The next day, the video was viewed on his Facebook page by the Batu Gajah police district’s criminal investigation department.

       He was charged under Section 233(1)(a) of the Communications and Multimedia Act 1998, and if found guilty he can be fined a maximum of RM50,000 or imprisonment for up to one year or both.

       His case was prosecuted by DPP Liyana Zawani Mohd Radzi, while Roshafeez was represented by lawyers Keshvinder Singh and Sukhdave Singh.

       Liyana requested that the court set bail for RM10,000, but Keshvinder asked for a minimum bail.

       Keshvinder said his client was married with five children, and was selling "nasi lemak" in front of his house in Kuala Kangsar.

       "He earns only about RM1,500, and the purpose of bail is to ensure that the accused attends court hearings," he said.

       Norita fixed bail at RM5,000 with one surety, and fixed Jan 25 as the next mention date.

       State police chief Comm Datuk Mior Faridalathrash Wahid had on May 11 this year confirmed that the accused had been arrested for using vulgarities to criticise the ongoing movement control order in a video.

       He had said the man had been released on police bail after having his statement taken, and they have started investigations and will refer to the deputy public prosecution if there is any action to be taken against the man.
