KANGAR: A sales clerk of a private company has been fined RM4,500 by the magistrate’s court here for keeping obscene photos and videos in his mobile phone last year.
Magistrate Kamaliza Md Zain meted out the sentence on Asyraf Hafizuddin Abdul Jalil, 26, after he pleaded guilty to committing the offence.
The court also ordered the accused to serve 12 months in jail if he failed to pay the fine. The accused paid the fine, Bernama reported yesterday.
Asyraf Hafizuddin was charged with having 80 photos, 163 videos and one electronic file (PDF) that are obscene in nature in his mobile phone at a house in Taman Jelempok Jaya, Kampung Utan Kandis, Arau here at 11.30am on March 31.
The charge was framed under Section 292 of the Penal Code which provides for a jail term of up to three years, a fine, or both, upon conviction.
Earlier, Asyraf Hafizuddin, who was unrepresented, pleaded for a lenient sentence as this was his first offence.
However, Malaysian Communications and Multimedia Commission deputy public prosecutor Fazril Sani Mohamed Fadzil urged the court to impose a deterrent sentence.
