ICE agent shoots man in face in New York; victim in serious condition: reports

       A man in New York City was shot in the face Thursday morning during an incident that involved a U.S. Immigration and Customs Enforcement (ICE) agent, according to local media.

       An agent was serving a warrant around 8:15 a.m. on 12th Street in the Gravesend section of Brooklyn, WPXI-TV reported, citing police.

       ICE officers were "physically attacked" while attempting to arrest Gasper Avendando-Hernandez, a twice-deported Mexican national with a 2011 assault conviction in New York City, ICE said in a statement. The ICE agent fired his gun at least once during the scuffle.

       While serving the warrant to Avendando-Hernandez, his girlfriend's son, 26-year-old Eric Diaz, got into a fight with officers, WABC-TV reported. The agent fired his gun and struck Diaz in the face, according to local media.

       The 26-year-old man suffered non-life threatening injuries and was treated at Maimonides Medical Center, according to NY1.

       Two ICE officers also were transported to a local hospital for treatment, the agency said.

       Avendando-Hernandez and a second individual who ICE has yet to identify were taken into custody, the statement said.

       The Mexican national had been arrested days earlier for possession of a forged Connecticut license plate, WABC reported.

       "ICE attempted to lodge an immigration detainer after his most recent arrest, however the subject was released from local custody before ICE could lodge a detainer," the agency said. "This forced ICE officers to locate him on the streets of New York rather than in the safe confines of a jail."

       ICE is investigating the incident and said further details are not immediately available.
