       KUWAIT CITY, Dec 14: The renewal by the Public Authority for Manpower (PAM) of what the legal sources called ‘internal circular’ which bans private sector companies from giving their foreign workers more than 50 dinars increment a year is illegal and unconstitutional from their point of view because it violates the articles of the Constitution and discriminatory in nature.

       The sources say this came despite the fact that the judiciary has cancelled the decision that was issued by PAM to prevent the renewal of the residence of non-graduate expatriates who are 60 years and above calling it a violation of the provisions of the law. Legal sources told the daily that the instructions in the circular do not apply to citizens and this is a clear violation of the provisions of the Constitution which guarantee the right to equality and rejects all forms of discrimination.

       The sources pointed out the circular violates the right to property, because the decision to increase on not to increase the wages of expatriate workers is subject to the will of the managers in the private sector, or rather the employer, the owner of the facility and the contracted foreign worker, and therefore is at the discretion of the employer to decide whether to increase salaries of foreign workers to 50 dinars or more.
