Sentencing hearing delayed for man accused of sex abuse in Fairfax County

The sentencing hearing for a man accused of sexually molesting two girls in Fairfax County was delayed Friday because the judge slated to preside over the case was ill, according to an attorney.

The family of one of the victims is waging a legal battle, hoping to persuade a judge that the plea deal worked out between Oscar Zaldivar, 53, and Fairfax County prosecutors is too lenient. The deal would cap Zaldivar’s sentence at a maximum of a little more than 17 years.

Zaldivar pleaded guilty to a handful of counts earlier this year for molesting a young girl who is his relative over a number of years. He’s also accused of sexually abusing a nonrelative.

The sentencing hearing is now scheduled to be heard on Monday in Fairfax County Circuit Court.
