Better employee protection after Parliament approves Employment Act amendments

       KUALA LUMPUR: There will now be better protection for employees, including a provision for flexible working arrangements, after the Dewan Rakyat passed amendments to the Employment Act.

       The amendments also cover provisions against sexual discrimination, forced labour practices as well as better maternity and paternity benefits.

       The Employment (Amendment) Bill 2021 was tabled in Dewan Rakyat in October last year for its first reading and covers 46 clauses to enhance the Employment Act 1955 (Act 265).

       During debates, Deputy Human Resources Minister Datuk Awang Hashim described the Bill as a significant step to improving workers' benefits.

       Among the amendments is the extension of maternity leave from 60 days to 98 in line with recommendations of the International Labour Organisation (ILO).

       Also included is the introduction of three days' paternity leave for male employees.

       It will also restrict the termination of female employees who are pregnant.

       Employees will also be able to apply for flexible working arrangements, which covers work duration and place of work.

       Employers who threaten, deceive or force an employee to do any work and prevent an employee from leaving their place of work can now be prosecuted.

       Those convicted face a fine of up to RM100,000, or imprisonment not exceeding two years, or both.

       Employers are also required to display notices at the workplace to raise awareness on sexual harassment.

       Awang said the amendments were aimed at contract workers and the government is currently mulling specific laws to protect those employed in the growing gig economy.

       Awang also said that the government had taken note of the suggestions by MPs to raise paternity leave to seven days instead of the three days initially proposed under the Bill.
