The Government has added a measure to the Automated Vehicles Bill which will require every driverless car to be at least as good at navigating the roads as a “careful and competent driver”.
Ministers say this will actually make them better than the “average” driver, because that includes motorists who drive while tired or fail to pay attention.

New laws are needed because drivers are currently held responsible for their vehicles but legislation will allow every person in the vehicle, wherever they sit, to be treated as a passenger. Instead businesses such as the car’s manufacturer could be held accountable for accidents.

There were 1,711 deaths in traffic accidents in 2022 and the Government argues that driverless cars will save hundreds of lives.
Self-driving buses are already being tested in Edinburgh and self-driving heavy goods vehicles are being trialled in Sunderland, although all these vehicles currently have drivers on board who can take over if needed.
Self-driving cars will also be subject to a “detailed technical cybersecurity assessment” to ensure criminals and terrorists cannot seize control remotely and create havoc.
It follows warnings from the Motor Insurers’ Bureau, which told MPs self-driving cars could be “hacked” and controlled remotely by terrorists to be used as a lethal weapon.

The Government is working with the National Cyber Security Centre, part of the security services, to tackle potential threats.
A Department for Transport spokesperson said: “The Automated Vehicles Bill has safety at its heart, which is why it includes rigorous standards and legal accountability.
“The Bill will unlock a transport revolution, getting self-driving vehicles on the road to make travelling safer, more convenient and more accessible, while putting the UK at the forefront of a fast-growing, multi-billion-pound industry – part of our plan to grow the economy.”
It is expected that 40 percent of new cars in the UK could have self-driving capabilities by 2035. The Government argues that regulations allowing the vehicles on UK roads will also encourage the development and manufacture of automated vehicles in the UK. The UK market could be worth as much as £42 billion by 2035, creating as many as 38,000 jobs in the sector, according to the Department for Transport.
