Prince Harry could see his future in the United States come into question now his visa application had been handed over to a federal judge.

The Duke of Sussex has been challenged on whether he might have lied on his visa application after revealing in his memoir Spare he had taken drugs.

Under current US legislation, applicants for certain types of US visa need to disclose whether they have used drugs – and doing so can result in their request being denied.

Washington-based The Heritage Foundation last year lodged a request for the release of Harry's application - and the papers have now been handed to Judge Carl Nichols.

Should the Duke be found to have lied on the application, he faces the prospect of seeing his visa cancelled and his future in the US could be in the balance.

Royal commentator Charlotte Griffiths argued the Duke "invited the witch hunt" when he claimed to have taken multiple drugs including magic mushrooms in his autobiography.

She argued Harry is likely "very anxious" to learn what is going to happen and admitted she was surprised the Heritage Foundation's request had sparked a similar raucous.

Speaking to GB News, Griffiths said: "I'm actually amazed we've got here, because this feels like it's been rumbling on for months and months.

"At first it felt like a bit of a stunt from the Heritage Foundation. They did the freedom of information request, and we wondered if it would really lead to anything.

"But this moment is really big because it's actually led to something, this is really happening now."

The royal author noted the Duke would likely have avoided any questions about his visa status had he not included anecdotes about his experience with drugs in his book.

The Duke's own defence lawyer, John Bardo, appeared to suggest last month that Harry might have exaggerated some of his claims and that "the book isn’t sworn testimony or proof”.

Griffiths continued: "Sure, there's a witch hunt, but was it invited? I think it probably was, because Harry's written about this in a book, to sell books to make money.

"It's so ironic isn't it, that the whole of Spare is about how hard done by he is and how he's not actually that privileged because his brother gets all the privilege. And yet it's actually this book that's getting him in so much trouble.

"It seems like perhaps he was chancing his luck or he thought he'd get away with it, but that's just not the case. He's a serious public figure, and he's admitted to drug use in a book whilst living in America."
