       The figures were published by NHS Resolution, which allows injured patients or their families to resolve claims for compensation against the NHS in England without court proceedings.

       It revealed the total cost of claims for clinical negligence was £2.8 billion, including damages paid to claimants of £2.1billion, claimant legal costs of £545million and NHS legal costs of £169million.

       Some hospital trusts faced bills of almost £100 million with Barts Health NHS Trust in London giving paying £94.5 million, Mid and South Essex NHS Trust paying £65 million and Manchester University NHS Trust paying £61 million.

       Compensation bills have shot up, with the total sum more than double the £1.2 billion paid out across the NHS in 2014-15.

       NHS Resolution highlighted an ongoing review into the quality and safety of care at Nottingham University Hospitals maternity services as well as a review of East Kent Hospitals NHS Trust which found in 2022 that 45 babies had died unnecessarily, and a House of Commons report in 2023 which found black women are almost four times more likely to die in childbirth than white women.

       It said in its annual report that these “reinforce the need for ongoing concern around avoidable error and disparity of outcomes in maternity care.

       “Such incidents can cause devastating consequences for the child, parents and wider family, as well as the NHS staff involved. Reports of the lived experience make the stress, grief and trauma of those affected desperately apparent.”

       Figures were highlighted by the Liberal Democrats. Lib Dem Hospitals and Primary Care spokesperson Jess Brown-Fuller said: “These figures expose the true cost of years of neglect under the previous Conservative government. Each payout represents the horrific trauma endured by too many patients, who are forced to navigate an NHS that has been run into the ground.

       “The Conservative Party should hang its head in shame but the new government’s approach to rescuing our NHS currently resembles nothing more than kicking the can down the road.

       “From new hospitals to social and maternity care, Ministers need to stop embracing the false economy of dither and delay and finally start delivering on our NHS.”

       She called on the Government to press ahead with a planned review of social care implement the full recommendations of a review into maternity services at the Shrewsbury and Telford Hospital NHS Trust, which called for changes in maternity care across the UK.

       A Department of Health and Social Care spokesperson said: “This government inherited a broken NHS, with the costs of clinical negligence claims more than doubling in the last decade.

       “Our sympathies are with those affected and we are determined to ensure that all patients - including women and their babies - receive safe, personalised and compassionate care.

       “It will take time to turn the NHS around, but we have already started by delivering 2 million more appointments seven months ahead of schedule.”
